General conditions – Mobility Equipment rental terms.

The specific terms and conditions governing this contract are detailed below:

Lessor is the owner of the leased material, i.e. the company Movilidad Ampliada S.L.

Lessee is the natural or legal person who leases the equipment.

The lessee declares to be over 18 years of age, and to have a valid identity document (passport, ID card, Spanish Tax Identification Number, Foreigner's Identity Number). The hirer is the holder of this rental contract and is responsible for the rented equipment and/or material, which may only be used by the persons designated by the hirer.

Payment method: credit card, Paypal and Bizum, for online contracts or cash and credit card and Bizum, for rental contracts made in the physical store.

The duration of the rental is calculated by calendar days from the time of delivery of the rented equipment to the day of collection.

The amount of the rental, as well as the deposit, shall be paid prior to the delivery of the rented material. The renter must present the ID card or passport upon delivery of the material. The deposit will be returned upon delivery of the product and accessories rented. The Company receives from the Customer a deposit as a deposit, in advance and for an amount that varies depending on the type of product rented. The amount can be paid in cash or by credit/debit card/transfer or Bizum.

If any of the conditions set forth in this contract are breached, the lessor may terminate the contract and withdraw the leased product from the lessee, without the need to take legal action. All expenses arising as a result of such breach shall be borne exclusively by the lessee, the cost of which shall be deducted from the deposit.

The lessor may unilaterally terminate the contract before its conclusion in case of serious breach by the lessee in the use and care of the rented equipment and material. In this case, all rented equipment and/or material may be removed at the place where it is located without the lessee being entitled to any type of claim or compensation.

In the event of an accident or incident affecting the mechanical condition of the rented equipment, the hirer is obliged to report it immediately to the contact telephone number provided.

It is forbidden to use any type of rented mobility product on urban roads. Its exclusive use is to circulate on the sidewalk, commercial areas, pedestrian areas and parks (electric scooters, wheelchairs, etc.).

The lessee accepts the perfect working condition of the equipment received at the signing of this contract.

An unjustified delay in the return of the rented equipment will be subject to a penalty. The lessee shall pay daily to the lessor the amount of 35 Euros (thirty-five Euros) in the case of scooters and basic wheelchairs and 70 Euros (seventy Euros) in the case of folding scooters and premium wheelchairs, 35 Euros (thirty-five Euros) in the case of stair lifts, 30 Euros (thirty Euros) in the case of manual wheelchairs and rollators and other rental products, until the delivery of the rented material is made effective.

The equipment rented shall be delivered by the lessor in perfect working order and cleanliness.

The lessee shall return the rented material and its accessories, in the same state in which he received them, and at the place, date and time agreed upon. The lessee undertakes to act diligently to avoid theft, total or partial deterioration of the scooter or any accident. In case of damage, breakage or loss of the rented equipment due to negligence or involuntary cause, the lessee shall be liable with the deposit, except for those malfunctions resulting from normal wear and tear of the rented equipment at the discretion of the company's manager. In case of loss, theft or robbery of the rented material, Movilidad Ampliada S.L. may claim additional compensation up to the market value of the material in question.

Rental contracts may be modified or cancelled free of charge up to 48 hours before the start date of the rental. After this time, only the deposit will be refunded.

In case of theft, robbery or loss of the rented material, the lessee must report it to the police and notify Movilidad Ampliada S.L. the week following the robbery. The lessor will invoice the lessee as new material and at market price any leased and returned material that is unusable or those leased materials that have been stolen or robbed.

The lessor declares to have a civil liability insurance that covers any damage that may be caused as a consequence of defects in the rented material; however, the lessor shall not be liable for claims for accidents, injuries, blows or damages caused to the lessor and/or third parties, to their persons or goods, or to their property, or for loss of objects caused for any reason beyond the control of the Company.

The lessee shall take special care in the handling and conservation of the material received and its accessories. The cost of transporting, loading and unloading the equipment, including the return trip, shall be borne by the Hirer.

In the event of any damage to the rented equipment, the Hirer must contact the Rental Firm to inform it of this fact. In case the problem arises outside Madrid, Accessible Madrid is not responsible for the delivery to our facilities or the associated costs. The customer will be responsible for sending the rented product back to our store for inspection.

All taxes, fees, duties and taxes accrued from the rental of the equipment shall be borne by the lessee.

The rented equipment may not be the object of economic traffic or of economic or other compensation. The use of the rented equipment by a person other than the Hirer or an authorized person shall be at the sole responsibility of the Hirer, who shall be liable at all times for any breakage, damage, loss, etc. suffered by the goods. The lessee, on his own initiative, may not integrate any element in the leased material. The total disassembly and/or partial manipulation of the rented material is forbidden.

According to the provisions of that law, and in order to ensure the protection and privacy of your personal data. Product warranty

The warranty period is, by default, three years -except for batteries in electrical products, which is 6 months-. After 6 months it will be the customer's responsibility to prove that the defect in the product was of origin. Withdrawal and return of products

The products offered at www.accessiblemadrid.com admit the right of withdrawal. The product will be returned in perfect condition (beyond verification by the customer that the product has been delivered in perfect working order and use).
